Terms of Use

1. Agreement

These Terms of Use govern your use of the Hark AI Agent: Personal Assistant & Chat browser extension and its related services ("Hark"), published by NextApps AI, the brand of independent developer Roman Vlasov ("we", "us"). By installing or using Hark you agree to these Terms and to the Hark Privacy Policy. If you do not agree, do not use Hark.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Hark, and old enough to enter a binding contract to buy Hark Pro. If you use Hark for an organization, you confirm that you are allowed to accept these Terms for it.

3. The service

Hark is an AI assistant in your browser's side panel. It can answer questions, work with the page or email you choose to share, draft email replies, keep a Tracker of your tasks, orders, bookings, deadlines and bills, and — in Agent mode — perform steps on a website on your behalf. Features may change as we improve the product. Hark is not affiliated with or endorsed by Google, Microsoft or the websites you use it on.

4. Agent mode and your approvals

In Agent mode Hark clicks, types and navigates in the tab where you start a task. You stay in control: you can stop a task at any time, and Hark asks for your approval before any step that sends, submits, books, orders, pays, subscribes or deletes. Any booking, purchase, message or other action you approve is your own action, made with the website or service concerned and under its terms; NextApps AI is not a party to it and is not responsible for the goods, services, prices or availability offered there. Review what Hark is about to do before approving. Hark never enters passwords or payment details — you complete those steps yourself. Some websites do not allow automated use; use the Agent only where you are allowed to.

5. Third-party websites and services

Hark works on websites and email services run by others. Your use of them is governed by their own terms and privacy policies. Payments for Hark Pro are processed by Dodo Payments, and AI answers are generated by third-party AI providers (see the Privacy Policy). We are not responsible for third-party websites or services.

6. Plans, subscriptions and billing

Hark offers a free plan with a daily limit on AI requests (currently 1 request per day) and a paid plan, Hark Pro, with unlimited requests (subject to fair use: automated or abusive traffic may be rate-limited). Current limits are shown in Settings and reset every day at 00:00 UTC. We may adjust free-plan limits to keep the service reliable and fair.

Plans and prices. Hark Pro is offered as a weekly (US$5.99), yearly (US$49.99) or monthly (US$14.99) subscription. The price shown in the extension and at checkout is the price you pay and includes applicable taxes; checkout may show it in your local currency.

Free trial. The weekly plan starts with a 2-day free trial. A payment method is needed to start it. If you don't cancel before the trial ends, the weekly price is charged automatically and then every week. We may limit free trials to one per customer.

Merchant of record. Payments are processed by Dodo Payments, which sells Hark Pro to you as merchant of record. Your purchase is also subject to Dodo Payments' terms, and receipts and card statements show Dodo Payments.

Automatic renewal and cancellation. Subscriptions renew automatically at the end of each period until you cancel. You can cancel, switch plans or update your card at any time in Settings → Manage subscription or from the link in your receipt email. After you cancel, Pro stays active until the end of the period you have paid for. Uninstalling the extension or using “Delete all my data” does not cancel your subscription.

Failed payments. If a renewal payment fails, Pro may be paused until the payment method is updated. Hark shows a reminder with a link to update your card.

Refunds and withdrawal. If something went wrong with a charge, write to romanvlasovdev@gmail.com — we review refund requests individually and in good faith. If you live in the EU or UK, you may have a 14-day right of withdrawal for digital services; by starting Hark Pro immediately you ask us to begin the service during that period, and statutory rules on partial refunds apply. Nothing in these Terms limits refund or withdrawal rights you have under mandatory consumer law.

Other browsers. A subscription is linked to the browser where you bought it. You can use it in up to 3 browsers with “Restore purchase” by entering a one-time code sent to the email you used at checkout. Subscriptions are personal; sharing them with other people is not allowed.

Price changes. We may change prices for future billing periods. We will tell you in advance, and you can cancel before the new price applies.

7. Acceptable use

You agree not to use Hark to:

• break the law, infringe others' rights or process content you are not allowed to share;
• send spam, impersonate others, or create content that harasses, threatens or exploits anyone;
• use the Agent on websites or accounts you are not authorized to use, to bypass security measures, CAPTCHAs or paywalls, to scrape websites in breach of their terms, or to buy or book things you are not entitled to;
• attempt to bypass limits, reverse-engineer or copy the service, overload it or access it with automated scripts;
• circumvent the safety measures of Hark or of our AI providers, or violate their usage policies.

We may suspend access for anyone who misuses the service.

8. AI output

Answers, drafts, extracted Tracker items and Agent steps are generated by AI and can be inaccurate, incomplete or out of date. Review results — especially dates, amounts, email drafts and anything with legal, medical, financial or safety impact — before relying on them or approving an action. Hark is not a substitute for professional advice. You are responsible for how you use the output. Do not share sensitive personal data, passwords or confidential information you are not allowed to share.

9. Your content

You keep the rights to what you send and to the answers Hark generates for you, to the extent the law allows. You give us permission to process your content only to provide the service, as described in the Privacy Policy. We do not use your content to train AI models. You are responsible for having the right to share the content you send.

10. License and intellectual property

We grant you a personal, non-exclusive, non-transferable, revocable license to use Hark under these Terms. The extension, its code, design, name and logo remain the property of NextApps AI. Feedback you send us may be used to improve Hark without obligation to you.

11. Disclaimer

Hark is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law. We do not guarantee that the service or the Agent will work on every website or that it will be uninterrupted or error-free.

12. Limitation of liability

To the maximum extent permitted by law, NextApps AI is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or business, arising from your use of Hark, including actions you approved in Agent mode. Our total liability for any claim is limited to the amount you paid for Hark in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or rights you have under mandatory consumer law.

13. Suspension and termination

You can stop using Hark at any time by uninstalling it. Uninstalling does not cancel a Hark Pro subscription — cancel it in Settings → Manage subscription if you no longer need it. Use “Delete all my data” in Settings first if you want your anonymous server record removed. We may suspend or end access if you seriously or repeatedly break these Terms. We may stop offering Hark or any feature, with notice where reasonably possible; if we discontinue Hark Pro, we will stop future renewals and handle unused prepaid periods fairly.

14. Governing law and disputes

Please contact us first — most issues can be solved quickly by email. These Terms are governed by the laws of the country where the developer is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims in its courts. EU consumers can also use the EU's online dispute resolution information.

15. General

These Terms and the Privacy Policy are the entire agreement between you and us about Hark. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a reorganization, merger or sale of assets, which does not reduce your rights.

16. Changes

We may update these Terms. We will update the date above and, for material changes, tell you inside the extension in advance. Continued use after changes take effect means you accept them; if you do not agree, stop using Hark and cancel any subscription.
